Starting from the complexity of conceptualizing and classifying disability, under a human rights perspective strengthened by the theories of mediate and immediate effectiveness and the objective dimension of rights in labor relations, the objective of this work is to analyze the violation of the essential content of the human right to work when discrimination in the field of employment operates to the detriment of people with disabilities, in contravention of the regulations applicable in the Mexican legal system, and ignores the diversity of mechanisms implemented to guarantee them. In the final part of the work, based on analytical and comparative methods, the various practices and strategies implemented in Latin America and South America that have contributed to the materialization of labor inclusion for people with disabilities are studied.
